switchs under clutch and brake are fine , also these would not stop the cruise control from powering on ,they would just keep disengaging it according to a forum on bimmerwerkz
im stumped on this one
I'm telling you they would!

The car needs to know the what the clutch is doing and also the brake application before allowing the cruise control to engage.

Would love to know how you tested them.

A diagnostic will tell you exactly what is wrong.

i just took them out and had a look at them john , i did run a diagnostic on inpa and nothing showed the only reason i thought they where fine was because of what i read on another forum that if they where faulty the cruise control light would still come on on the dash , if the brake one was faulty would that not stop the brake lights from functioning ? , i might just chance it and change them as you siad there only cheap as im running out of ideas

When you press the cruise button on the steering wheel, what happens? Does the cruise light come on?

absolutely nothing at all happens john

maybe conor was right the car probably just doesn't have it , do you know where the cc module is located ?
Have you tried removing the steering wheel Gar? maybe something is disconnected?

tested it on inpa all buttons working on the steering wheel , this might sound a bit dumb but could it just be the bulb in odometer when you activate cruise control aside from the little symbol coming up on the odo does anything else come on say where the mileage is or something

Bulbs? I thought the E39's use LCD's no?

If it was something like that it would have come up on the diagnostic.

Try the same with your clutch switch.

It may not be broken but just not making proper contact with the pedal. Hence wy it didnt show up on the diagnostic.

okay little update tested the clutch switch today with thourough daignostic as you can see from the pic it works fine highlights when clutch is pressed and clutch switch is activated -deactivated , tested the odometer the cruise control symbol lights up and the cc buttons on the mfsw work , i then went into the cruise control option which i hadn't seen before and it siad no response from control unit so i presume i need a new module does anyone know if i can just grab one from any e39 or would it have to be from a 525i also will it have to programed or is it plug + play thanks

its your maf i guarentee it.. i had exact same prob.. when u first start the car dont pres the brake then press the cc on button and the light should come on.. and then press the brake it should go off and not come back on until u restart the car.. that happens with a faulty maf..
Ok done the above and the light came on then went off when I started car/touch brake pedal.
So now I'm wondering what or where the MAF is? Is it a big job? Costly?

Thanks lads,
Rob.
